These Terms of Use (“Terms”) are a legal agreement between you and SubieEvents, LLC (“SubieEvents”, “we”, “us”, “our”) governing your access to and use of our websites and services (collectively, the “Services”), including this website (boxerfest.com).

By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services. Our Privacy Policy explains how we collect, use, and disclose information.

1) Eligibility

You must be at least 13 years old to use the Services. If you are under 18, you may use the Services only with the involvement of a parent or guardian.

2) Accounts, Security, and Communications

  • You are responsible for activity associated with your account and for keeping access links, codes, and credentials secure.
  • We may send transactional communications related to purchases, registrations, account activity, and support issues.
  • Marketing communications are optional and are governed by the choices you make through the Services and the instructions included in those communications.

3) Ticket Purchases, Event Participation, and Refund Rules

  • Event changes: events may be modified, postponed, relocated, or canceled due to weather, venue requirements, safety issues, operational needs, or other circumstances outside our control.
  • Refunds, exchanges, and transfers: any rights to a refund, exchange, or transfer are governed by the rules shown on the applicable ticketing flow or in event-specific communications for the relevant event and ticket type.
  • Code of conduct: you agree to follow event rules, venue rules, activity-specific rules, and applicable law, and to behave in a safe and respectful manner.

4) Assumption of Risk; Release

Attending and participating in live events involves inherent risks, including risks of injury, illness, property damage, vehicle-related hazards, crowd conditions, weather conditions, and other risks. To the fullest extent permitted by law, you voluntarily assume those risks.

To the fullest extent permitted by law, SubieEvents and its affiliates, owners, staff, volunteers, contractors, sponsors, and partners will not be liable for losses arising from your participation except to the extent caused by our gross negligence or willful misconduct.

5) Event Photography, Video, and Publicity

Attendance at an event may result in photography, video, audio capture, or similar media capture for event operations, security, editorial, archival, promotional, website, and social media uses. By attending an event, you acknowledge that you and property you bring to the event may appear in those materials.

6) Vendors, Sponsors, and Other Third Parties

  • Vendors, sponsors, venues, media partners, and other third parties are independent parties and may offer products or services through or around the Services.
  • If you choose to receive communications from a specific vendor, sponsor, or partner, your information may be disclosed to that company as described in our Privacy Policy.
  • We are not responsible for the acts, omissions, policies, or content of independent third parties.

7) Acceptable Use

You agree not to:

  • Use the Services for unlawful, harmful, abusive, or fraudulent purposes.
  • Attempt to access accounts, admin tools, or data without permission.
  • Interfere with or disrupt the Services, including through scraping, automated abuse, or unauthorized security testing.
  • Upload malware or attempt to bypass security, rate limits, or access controls.

8) User Content and Public Profiles

If you submit content, including photos, vehicle details, build information, profile text, or other materials, you represent that you have the right to do so and that your submission does not violate another person’s rights or applicable law.

You grant SubieEvents a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, distribute, and use that content to operate, administer, and promote the Services and associated events. If you enable public-profile publication, that license includes displaying the content on public profile pages and related public-facing areas of the Services.

You are responsible for what you choose to publish publicly. Public content may be copied, indexed, cached, or shared by others once made public. We may moderate, remove, restrict, or hide content or profiles at any time.

9) Intellectual Property

The Services, including site design, text, graphics, logos, software, and other content we provide, are owned by SubieEvents or its licensors and are protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Services without our prior written permission.

10) Additional Event or Activity Waivers

These site-wide Terms are not a substitute for separate event-specific or activity-specific waivers. If an activity such as autocross, rallycross, off-road participation, or a similar activity requires an additional release or waiver, you must also agree to that separate document where required.

11) Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT PERMITTED BY LAW, SUBIEEVENTS DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12) Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SUBIEEVENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

13) Indemnification

You agree to defend, indemnify, and hold harmless SubieEvents and its affiliates, owners, staff, volunteers, and contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services, your submissions, or your violation of these Terms.

14) Changes to the Services or These Terms

We may update the Services and these Terms from time to time. If we make material changes, we will take reasonable steps to provide notice. Your continued use of the Services after changes become effective means you accept the updated Terms.

15) Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles, except where applicable law requires otherwise.
